- Procedural Maneuvering: In this same case, the seller’s counsel filed a motion to dismiss one of the counts against a defendant. Sandollar argued this was procedurally incorrect, as the lack of sufficient facts alleged is grounds for a motion to strike—which can typically be cured by amending the complaint. Sandollar subsequently filed a motion to amend the pleadings. Adding to the procedural missteps, the seller’s counsel missed their own extended deadline to answer the complaint for another defendant while focusing on the improper motion. Following legal research and travel to Bridgeport for a hearing, the judge ultimately granted the motion.
2. Trade Name Defense in State Court
While many intellectual property disputes play out in federal court, state courts also handle significant trademark and trade name litigation.
- Medical Services Trade Name Dispute: Sandollar Law was asked to defend a Bridgeport Superior Court case concerning the trade name of a medical services company. One issue with the claim is the difficulty of proving “acquired distinctiveness” for a purely descriptive trade name. Establishing this usually requires expensive survey evidence, presenting a high financial and evidentiary hurdle for the plaintiff.

The Judge ultimately granted our motion to cite in the cross-defendant and ordered the plaintiff to amend their complaint to incorporate the facts Sandollar pleaded in our cross-complaint.
