This Week at the Firm
Despite the rainy weather, it was a highly productive week at the firm, with significant developments across our intellectual property, civil litigation, and corporate dockets. Here is a look at how we advanced our clients’ interests over the past few days.
Intellectual Property & TTAB Proceedings
Protecting intellectual property rights requires navigating both federal patent analysis and complex trademark board procedures:
* The firm conducted a comprehensive patent infringement analysis comparing US Patent 11,172,665 to a client’s adjustable fishing rod holder product.
* For a contested trademark matter, the firm reviewed the specific rules of the Trademark Trial and Appeal Board (TTAB) and held a discovery conference with opposing counsel.
* In the same trademark matter, the firm successfully prepared and filed a response to a USPTO Office Letter to overcome a refusal.
Property Disputes & Civil Litigation
Active litigation requires a balance of aggressive discovery enforcement and nuanced legal research:
* In a property dispute, the firm conducted deep legal research into easements for light and air.
* To advance the fact-finding phase of that property dispute, the firm prepared and served a robust discovery package, including interrogatories, requests for production, requests for admission, and a formal notice of inspection. We also coordinated with opposing counsel to file a motion for a continuance and a revised scheduling order.
* For a home care business lawsuit, the firm performed legal research and subsequently filed an objection to the opposing party’s motion for an extension of time to respond to discovery, while simultaneously filing a motion for orders of compliance.
* The firm communicated with opposing counsel regarding the court’s official grant of a Prejudgment Remedy (PJR) in a commercial dispute.
* We cleared conflicts, then took on defense of a commercial debt collection lawsuit, filed an official appearance, and opened negotiations.
* The firm also held a conference and exchanged communications with co-counsel in an ongoing commercial litigation matter.
Corporate Formations
* For an automotive accessories contract manufacturer, the firm formed and registered a new LLC and obtained an EIN for the company. Waiting on set up of the company’s business checking account in order to gain a DRS sales tax permit.
