Driving Discovery and Compliance

Meaningful progress in litigation often requires forcing the other side’s hand in discovery. This week, the firm focused heavily on ensuring opposing parties met their obligations:

  • The firm aggressively pushed for discovery by filing and serving multiple motions for compliance with discovery across different commercial disputes.
  • In a home care business dispute, the firm filed motions for the disclosure of opposing parties’ assets and prepared a formal scheduling order.
  • For another corporate dispute, the firm filed notices of service for requests for admissions and accurately calendared key deadlines for the defendants’ first discovery responses.
  • We also reviewed incoming discovery responses and evaluated contracts from opposing counsel to maintain our case strategies.

  • The firm spent considerable time researching the Uniform Commercial Code (UCC) specifically regarding the sale of goods subject to imperfect security interests.
  • This UCC research was conducted alongside a deep review of loan agreements and timelines for a retail business client.
  • In a separate matter involving the theft of personal property, the firm researched municipal blight ordinance statutes.
  • Following this municipal research, the firm prepared dual motions to strike a Connecticut town’s special defenses.

Strategic Motions and Court Appearances

Navigating the procedural nuances of Connecticut courts requires constant attention to pleadings and hearings:

  • The firm prepared for and traveled to New Haven Superior Court to argue at a second hearing for a motion to dismiss in an ongoing commercial litigation matter.
  • We prepared and uploaded a comprehensive set of exhibits for an upcoming Prejudgment Remedy (PJR) evidentiary hearing.
